Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and FounderGem LLC, a Delaware limited liability company operating the Troja service at troja.dev ("Troja", "we", "us"). By creating an account or using the Service, you agree to these Terms. Questions: support@troja.dev.

1. The Service

Troja is a best-effort scanner that analyzes websites for security vulnerabilities, SEO issues, and AI/answer-engine visibility. Scan results are informational and do not constitute a guarantee that a site is secure. See our Disclaimer.

2. Eligibility and accounts

You must be at least 16 years old and able to form a binding contract. You are responsible for the activity under your account and for keeping your credentials confidential. Notify us promptly of any unauthorized use.

3. Authorization to scan

You may only scan websites and domains that you own or are explicitly authorized in writing to test. Scanning third-party systems without permission may be unlawful. Your use of the scanner is governed by our Acceptable Use Policy, which is incorporated into these Terms.

4. Plans, billing, and renewals

  • Paid plans are billed in advance through Stripe on a recurring basis until cancelled.
  • Fees are non-refundable except where required by law or expressly stated.
  • We may change pricing with reasonable notice; changes apply at your next renewal.
  • You can cancel at any time; access continues until the end of the paid period.
  • Failure to pay may result in suspension or termination of the Service.

5. Acceptable use

You agree not to misuse the Service, including by: scanning systems you are not authorized to test; attempting to overwhelm, reverse engineer, or circumvent the Service; reselling the Service without permission; or using it to violate any law. Full terms are in the Acceptable Use Policy.

6. Intellectual property

We retain all rights to the Service, including software, scan engines, and documentation. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription. You retain ownership of the websites you scan and the data you submit; you grant us a license to process that data to deliver the Service.

7. Customer data

You are responsible for the legality of the data and URLs you submit. We process your data per our Privacy Policy and, where applicable, our Data Processing Addendum.

8. Third-party services

The Service relies on third parties such as Supabase, Stripe, Railway, and Cloudflare. We are not responsible for the acts or omissions of third-party providers.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SCANS DETECT ALL VULNERABILITIES OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless FounderGem LLC from claims arising out of your misuse of the Service or your violation of these Terms or applicable law, including unauthorized scanning.

12. Termination

We may suspend or terminate your access for breach of these Terms or unlawful conduct. Upon termination, your right to use the Service ends and we will handle your data per our deletion process.

13. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless mandatory local consumer law provides otherwise.

14. Changes

We may update these Terms; continued use after changes means you accept them. The effective date above reflects the latest version.
